Data controller

The controller responsible for the data collected through the Services is Nicomatic Senegal, a subsidiary of the Nicomatic Group, headquartered at Point E, rue PE-40, Dakar, Senegal. Data we collect

Depending on how you use the Services, we may collect the following categories of data:

• Identification and contact data: name, professional email address, phone number, job title, and company name, when you fill in a trial, demo, or contact request form;
• Data related to your use of the Services: tool or module viewed, history of trial or quote requests, conversations via WhatsApp when you choose that channel;
• Browsing and technical data: IP address, browser and device type, pages viewed, date and time of connection, cookies and similar technologies (see Section 10);
• Data you provide directly: any information you share with us on your own initiative, notably by email, form, or instant messaging.

How we collect your data

Your data is mainly collected directly, when you: fill in a form on the Portal or on nicomaticsenegal.com (free trial, demo, quote, or contact request); browse our pages, through cookies and trackers placed with your consent where required; communicate with us by email, phone, or WhatsApp; or create and use an access account to one of our SaaS modules.

Purposes of processing

Your personal data is processed for the following purposes:

• Managing your free trial and demo requests and your access to the Portal modules;
• Handling the business relationship and technical support (responding to your requests, sending access credentials, following up on your file);
• Improving our Services, our catalog, and the Portal user experience, notably through anonymized or aggregated usage statistics;
• Sending you, with your consent where required, marketing communications about our offers, products, and news;
• Ensuring the security of our information systems, preventing fraud, and detecting misuse;
• Complying with our legal, accounting, and regulatory obligations.

Legal basis for processing

Depending on the case, our processing is based on: the performance of pre-contractual or contractual measures taken at your request (for example, when requesting a trial); your consent, notably for the use of non-essential cookies or the sending of marketing communications; our legitimate interest in ensuring the security, improvement, and promotion of our Services, while respecting your fundamental rights and freedoms; and compliance with legal obligations to which we are subject.

Sharing your data

Nicomatic Senegal does not sell or rent your personal data to third parties. Your data may nonetheless be shared, strictly as necessary, with:

• Nicomatic Senegal's internal teams and, where applicable, the Nicomatic Group, authorized to handle your request;
• Our technical service providers and subcontractors (hosting, email, customer relationship management tools, activity tracking tools), bound by contractual confidentiality and security obligations;
• Competent administrative or judicial authorities, where required by law.

International data transfers

Some of our technical service providers may be located outside Senegal. Where a transfer of personal data outside Senegal is necessary, we ensure it is governed by appropriate safeguards (contractual clauses, confidentiality and security commitments) providing an adequate level of protection for your data.

Data retention

We keep your data for no longer than necessary for the purposes for which it was collected, and in particular:

• Data related to a trial or demo request that did not lead to a subscription: up to 3 years from the last contact;
• Data related to an active account on the Portal: for as long as you use the Service, then archived for as long as required to meet our legal obligations;
• Connection data and technical logs: up to 12 months;
• Data required to comply with a legal, accounting, or tax obligation: for the period provided for by the applicable regulations.

Data security

We implement reasonable technical and organizational measures, consistent with industry standards, to protect your data against unauthorized access, loss, alteration, or disclosure: access control, encryption of sensitive exchanges, hosting with recognized providers, and training our teams in information security best practices.

Cookies and trackers

Our site uses cookies and similar technologies to ensure it functions properly, measure its audience, and, with your consent, improve your experience:

• Strictly necessary cookies: essential to the operation of the site and Portal (navigation, security, remembering your preferences);

In accordance with Senegalese Law No. 2008-12 of January 25, 2008 on the protection of personal data, as well as international best practices, you have the following rights over your personal data:

• Right of access: obtain confirmation that your data is being processed and receive a copy of it;
• Right to rectification: have inaccurate or incomplete data corrected;
• Right to erasure: request the deletion of your data, within the limits provided by law;
• Right to object: object, on legitimate grounds, to the processing of your data, in particular for direct marketing purposes;
• Right to restriction of processing;
• Right to data portability, where applicable;
• Right to withdraw your consent at any time, where processing is based on it, without affecting the lawfulness of processing carried out beforehand.
• You also have the right to lodge a complaint with Senegal's Commission de protection des données personnelles (CDP), the competent data protection authority.

To exercise any of these rights, contact us using the details in Section 15. We will respond as soon as possible and, in any event, within the timeframes set by applicable regulations.

Protection of minors

Our Services are intended for a professional audience and are not designed for minors. We do not knowingly collect data about minors. If you believe a minor has provided us with personal data, please contact us so that we can delete it.

Links to third-party sites

Our site and Portal may contain links to third-party websites or services (social networks, WhatsApp, partners). Nicomatic Senegal has no control over these third-party sites and disclaims any responsibility for their privacy practices. We invite you to review their own privacy policies.

We may update this Privacy Policy from time to time, notably to reflect changes in our Services or in applicable regulations. Any material change will be indicated by updating the date at the top of this page. We encourage you to review this page periodically.
